Terms of Service

1. Agreement to Terms

By accessing or using Afyore (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Afyore is a B2B SaaS marketplace platform operated by Afyore ("we," "us," or "our"). These Terms govern your use of our platform, which connects SaaS founders with growth promoters.

2. Description of Service

Afyore is a marketplace platform that facilitates:

• For Founders: Listing SaaS products, defining partnership opportunities, connecting with promoters, and managing partnership relationships
• For Promoters: Discovering SaaS products, expressing interest in partnerships, managing partnership activities, and tracking rewards

The Service includes but is not limited to:

• User profiles, role selection (founder or promoter) and authentication
• Profile pictures, including images you upload to our storage
• Product listings, launch, editing, pausing and permanent deletion
• Marketplace discovery, promoter directory and partnership requests
• A Partnerships workspace where requests are reviewed, accepted or declined
• Real-time in-platform chat between accepted partners, with automatic 144-hour deletion
• Unlocking of affiliate links or the founder's chosen contact method after acceptance
• Dashboard analytics and reward information
• Payment processing (currently in development)

3. User Accounts

3.1 Account Creation

• You must be at least 18 years old to use the Service
• You must provide accurate, complete, and current information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

3.2 Account Types

• Founder Accounts: For SaaS product owners who want to grow their products through partnerships
• Promoter Accounts: For marketing professionals, influencers, and growth experts who promote products

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Suspicious or fraudulent activity
• Inactivity for an extended period
• Any reason that, in our sole discretion, violates the spirit of these Terms

4. User Responsibilities and Conduct

4.1 General Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Provide accurate information in your profile and product listings
• Respond to partnership requests in a timely manner
• Honor agreed-upon partnership terms
• Maintain professional communication with other users

4.2 Prohibited Activities

You may not:

• Impersonate any person or entity
• Create false or misleading profiles or product listings
• Use the Service for spam, harassment, or abusive behavior
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service to violate any applicable laws or regulations
• Engage in fraudulent or deceptive practices
• Misrepresent your qualifications, experience, or capabilities
• Share confidential information about other users without permission

4.3 Partnership Integrity

• You must only express genuine interest in partnerships you intend to pursue
• You must fulfill partnership commitments you agree to
• You must not artificially inflate partnership metrics or rewards
• You must not create fake accounts or use bots to manipulate the platform

5. User-Generated Content

5.1 Content You Provide

You retain ownership of all content you submit to the Service, including:

• Profile information and descriptions
• Product listings and descriptions
• Profile pictures and images
• Messages and communications
• Partnership proposals and terms

5.2 License to Use Your Content

By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, display, and distribute your content on the Service
• Modify your content as necessary for technical purposes
• Create derivative works for Service improvements

5.3 Content Warranties

You represent and warrant that:

• You own all rights to the content you submit or have necessary permissions
• Your content does not infringe on any third-party intellectual property rights
• Your content complies with these Terms and applicable laws
• Your content is accurate and not misleading

5.4 Content Removal

We reserve the right to remove any content that:

• Violates these Terms
• Is illegal, harmful, or inappropriate
• Infringes on third-party rights
• Is reported as fraudulent or deceptive

6. Intellectual Property

6.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by Afyore and are protected by international copyright, trademark, and other intellectual property laws.

6.2 Third-Party Intellectual Property

The Service may include content, trademarks, or materials from third parties. These are used with permission or under license and remain the property of their respective owners.

6.3 Your Intellectual Property

You retain ownership of your intellectual property submitted to the Service. Your license to us does not transfer ownership.

7. Partnerships and Rewards

7.1 Platform as Intermediary

Afyore serves as an intermediary to facilitate connections between founders and promoters. We are not a party to any partnership agreements formed through the Service.

7.2 Partnership Terms

• Partnership terms are negotiated directly between founders and promoters
• Afyore is not responsible for ensuring fulfillment of partnership agreements
• Reward structures and payment terms are determined by the founders
• Disputes between users should be resolved directly between the parties

7.3 Rewards and Payments

• Reward tracking is provided as a convenience and may not be 100% accurate
• We are not responsible for payment disputes or non-payment
• Payment processing features (when available) are subject to separate payment terms
• Tax obligations are the sole responsibility of the individual users

7.4 Fraud Prevention

We reserve the right to:

• Investigate suspected fraudulent activities
• Suspend accounts involved in fraudulent behavior
• Report fraudulent activities to appropriate authorities
• Withhold rewards or payments pending investigation

8. In-Platform Chat, Contact Unlocking and Product Control

8.1 Partnership Chat

Afyore now provides a live, real-time chat inside each accepted partnership. Chat is available only between the two parties of that partnership — a founder and the promoter they have approved. Nobody else on the platform can read that conversation, and access is enforced at the database level, not just in the interface.

8.2 Automatic Message Deletion (144 Hours)

Partnership messages are stored only so both partners can read the conversation across their devices. Every message is permanently and automatically deleted from our database 144 hours (6 days) after it is sent, by an automated scheduled job, and it disappears from the interface at the same time. Chat is deliberately temporary: keep any agreement, link, invoice or commitment that matters to you somewhere you control. We are not able to restore expired messages for you.

8.3 Chat Policy Acceptance

Before sending your first message in a conversation you must accept the in-app chat policy. Accepting it confirms that you understand how messages are stored and deleted, and that you accept full responsibility for what you send.

8.4 Communication Standards

In chat and in every other communication on the Service, you must:

• Communicate professionally, respectfully and only about the partnership
• Not send harassment, hate speech, adult content, scams or spam
• Never request or share passwords, card details or other sensitive credentials
• Not pressure the other party into off-platform payment schemes they did not ask for

You are solely responsible for what you send. Afyore is not a party to any deal you make and does not verify claims, payouts, or affiliate terms exchanged in chat. Abuse may result in the partnership being closed and the account suspended.

8.5 Contact Details and Affiliate Links

Founders choose how they want to be reached: an existing affiliate program (platform, link and instructions) or a direct partnership via in-platform chat, email, LinkedIn, X, Instagram or Reddit. Those details stay hidden until the founder accepts a partnership request, at which point they are unlocked for that promoter only. You may not scrape, republish, resell or redistribute contact details or affiliate links obtained through the Service.

8.6 Deleting a Product

Founders can delete any product they have listed at any time from My Products. Deleting a product permanently removes the listing from the marketplace and also removes every partnership attached to it and the chat history inside those partnerships, for both sides. This action cannot be undone, and promoters who were working with that product will lose access to the workspace without further notice.

8.7 Message Monitoring

We do not sell your messages or use them for advertising. We may access or review messages, within their short retention window, only for:

• Fraud detection and prevention
• Investigating a report of abuse or a Terms of Service violation
• Security and platform integrity
• Legal compliance

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you agree to the collection and use of your information as described in our Privacy Policy.

10. Security

We implement reasonable security measures to protect your information. However:

• No method of transmission over the Internet is 100% secure
• We cannot guarantee absolute security
• You are responsible for protecting your account credentials
• We are not liable for unauthorized access to your account

11. Service Availability and Modifications

11.1 Service Availability

We strive to maintain high service availability but do not guarantee:

• Uninterrupted or error-free operation
• That defects will be corrected
• That the Service will meet your requirements

11.2 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any feature of the Service
• Impose limits on certain features
• Introduce new features or fees with notice

12. Pricing and Payment Terms

12.1 Current Pricing Model

Currently, Afyore is in beta and does not charge fees for basic platform features. This may change in the future with appropriate notice.

12.2 Future Pricing

When pricing is implemented, we will:

• Provide clear notice of any fees
• Allow users to opt-out before fees take effect
• Provide transparent pricing information
• Offer appropriate payment methods

12.3 Payment Processing

When payment features are implemented, additional payment terms will apply, including:

• Payment methods accepted
• Refund policies
• Dispute resolution procedures
• Tax obligations

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Using account deletion features in Settings
• Contacting our support team

13.2 Termination by Us

We may terminate or suspend your account for:

• Terms of Service violations
• Fraudulent or suspicious activity
• Extended inactivity
• Legal requirements
• Business reasons

13.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• Your account and data may be deleted
• You remain liable for any obligations incurred before termination

14. Disclaimers and Limitations of Liability

14.1 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

14.2 No Warranties

We disclaim all warranties, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Reliability or availability
• Accuracy or completeness of information

14.3 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from partnership disputes
• Damages from user-generated content
• Damages exceeding the amount you paid (if any) for the Service

14.4 Partnership Disclaimers

We are not responsible for:

• The quality or performance of partnerships formed through the Service
• Payment disputes between users
• The actions or conduct of any user
• The accuracy of information provided by users

15. Indemnification

You agree to indemnify and hold harmless Afyore and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your user-generated content
• Your partnership activities

16. Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

16.2 Arbitration

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

16.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or class-wide arbitrations.

17. General Provisions

17.1 Entire Agreement

These Terms constitute the entire agreement between you and Afyore regarding the Service.

17.2 Severability

If any provision of these Terms is found invalid, the remaining provisions shall remain in effect.

17.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver.

17.4 Assignment

You may not assign your rights under these Terms without our consent.

17.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via:

• Email notification
• In-app notification
• Posting on our website

Continued use of the Service after modifications constitutes acceptance of the updated Terms.
